Agency RelationshipsWho Represents Who, and You?According to the North Carolina Board of Realtors, agents must explain agency to you at first substantial contact. Most buyers and sellers, unfortunately, do not understand agency, but you should and need to know who represents who.
When you are involved in a real estate transaction in North Carolina, there are two teams: the selling team and the buying team. All realtors work for the selling team unless you, as the buyer, ask to be represented and have your agent look out for your best interest. This means that any information we know about a property that could influence the price or any other aspect of the transaction, must be passed on to you, as the buyer. The only way to have a realtor work for you is to have them work as your buyer's agent. To do this, you will need to sign a non-exclusive buyer's agency agreement or exclusive buyer agency agreement saying that you wish the realtor to work in your best interest. There are other types of buyer agency agreements, but with Wieland Properties, Inc. we only practice non-exclusive buyer agency agreements and exclusvie buyer agency most all of the time. The other type is an exclusive buyer agency agreement where you could be liable for a fee to your buyer's agent. With a non-exclusive agreement, our business is based on loyal clients at no expense to you. Why Having an Agent is a Good ThingUnless I am your buyers agent I cannot pass information on to you that may make a big difference in knowing all of the facts. At Wieland Properties, Inc. we take this part of our business seriously to avoid any conflicts and to get our buyers and sellers the best price. Sellers listing company pays the buyers agent. It cost you nothing to have a buyers agent unless you agree to under an Exclusive Agency.
Dual Agency: What is It?
This is when someone is representing you and the seller at the same time. Most agents like this because they get both sides of the commission. While these agents work hard for every penny they make, the question has to be raised as to whether they can fairly represent both parties at the same time?
At Wieland Properties, Inc. we do not think so, and therefore we pledge to our sellers that we will not ever personally work both sides of the deal without their total consent. We like to use designated dual agency so all parties have sincere, honest representation. On-Site Agents: Who Do They Work For?Who do you think on-site agents work for? If you said the seller/builder, you are right and they love it. Builders have realtor fees already worked into their pricing so you save nothing by using an on-site agent compared to having a realtor working just for you. Many times your realtor can help direct you towards options and upgrades with potential negotiability. The on-site agents are paid a percentage of the sales price just as realtors are paid. If the on-site agent sells the property, it's like dual agency again, but who do you think they are really working for? The bottom line is that it costs you nothing to have a realtor represent you at an on-site purchase because they have already accounted for the fees in the price. If you want to make sure you get the best deal possible, we recommend having an agent go with you, or, if you choose to go alone, tell them you have an agent.
